Terms and privacy
The fine print, in plain words.
How booking, payment, cancellations and weather work, what happens on board, and what we do with your information. Last updated October 18, 2026.
1Who we are and who runs your charter
- Private Charters Cabo is a booking agency. We connect you with independent, licensed yacht operators in Cabo San Lucas: we take your request, confirm the date, collect the payment and give you access to the yacht at the dock.
- We do not own, operate, captain or crew the yachts. Each yacht is run by its owner or operator, who employs the captain and crew and is responsible for the vessel, its maintenance, its permits, its insurance and everything that happens while it sails.
- When this site says our yachts, our fleet or our crew, it means the yachts and crews of the operators we work with.
- The operator of your yacht is named in your confirmation or given to you on request.
- Whoever books accepts these terms for the whole group and agrees to share them with every guest before boarding.
- Getting to the marina is not part of the service. You are responsible for your own transport to and from the dock.
2Booking and confirmation
- A message from the planner, WhatsApp, iMessage, SMS or email is a request, not a booking. Your charter is booked when we send your written confirmation and your deposit goes through.
- The deposit is paid through a secure link that we send with your confirmation, and the balance at the dock on the day.
- Your confirmation comes in writing: yacht, captain, slip, meeting time and the final price.
- Please check the confirmation right away. If anything is wrong, tell us in writing before the charter date.
3Prices, taxes and fees
- Rates are per boat, not per person, for the hours shown on each yacht page.
- Every charter rate includes the 16% tax (IVA). Food and drinks are listed at cash prices; credit card payments add 16% tax.
- Prices are listed in US dollars (USD) and Mexican pesos (MXN). Your payment link comes in the currency agreed in your confirmation.
- A 15% crew gratuity is customary and is not included in any rate. It is paid on board, at your discretion.
- The Sea Ray 65 meets you at Fisherman's Landing restaurant, by the Cabo Escape terminal.
- Parts of Land's End are a federal protected area with a CONANP conservation fee. On our charters this fee is already included in the price.
4Payment
- Once we confirm your date in writing, we send a secure payment link for the deposit. The deposit is required: your date and your yacht are held only when it goes through. Until then the date stays open to other requests; if it is taken before you pay, the link stops working and no charge is made.
- Payments are processed by Stripe. You can pay with a credit or debit card, and with Apple Pay or Google Pay where available. We never see or store your card number.
- Your total is the charter price with 16% tax included, plus any food and drinks you ordered. The crew tip is paid on the day.
- You pay the balance at the dock on the day of your charter, by card or in cash. If you would rather pay the whole charter in cash at the dock, ask us before you book; it has to be agreed in writing. If you prefer to pay the whole charter online, ask and we send one link for the full amount.
- Payment links are in US dollars (USD) unless the link says otherwise. Your bank may apply its own exchange rate and fees.
5Cancellations and refunds
- If you cancel more than 72 hours before departure, we refund 75% of what you paid.
- If you cancel between 72 and 48 hours before departure, we refund 50% of what you paid.
- If you cancel less than 48 hours before departure, or on the day, there is no refund.
- No-shows, late arrivals, seasickness or asking to return early do not qualify for a refund. If your group arrives late, the charter still ends at the scheduled time.
- Refunds go back to the original payment method. We process them within 3 to 7 business days of confirming the cancellation in writing, and your bank may take another 5 to 10 business days to show the credit.
6Weather, port closures and safety
- If the Port Captain closes the harbor, you choose: a new date or a full refund of what you paid.
- If the captain decides that conditions are unsafe before departure, the same choice applies.
- Light rain, clouds or a choppy sea that the captain considers safe are not grounds for cancellation.
- Safety decisions by the Port Captain and by your captain are final, including changing the route, skipping a stop or returning early. If a charter ends early for weather, we refund the unused hours.
7If the yacht has a problem
- If your yacht cannot leave because of a mechanical problem, we offer a comparable yacht if one is available, a new date, or a full refund. You choose.
- If a mechanical problem ends the charter early, we refund the unused hours.
8On board
- Each yacht has a maximum number of guests, shown on its page. It cannot be exceeded, children and babies included.
- Everyone on board follows the instructions of the captain and crew. The captain may change or end a charter for safety reasons.
- Life jackets are on board for every guest. Tell us the ages of any children when you book so the right sizes are there.
- We do not sell or serve alcohol on board, except on the Azimut 70 and the McKinna 70, whose charters include complimentary drinks served by the yacht's own crew. Whether the drinks come from that bar or you bring your own, everyone who drinks must be 18 or older, the legal age in Mexico, and drink in moderation. Illegal drugs are not allowed.
- Sport fishing is allowed only on the McKinna 70, on its sport-fishing charter, which includes a Mexican sport-fishing license for each angler on board. The other yachts are pleasure yachts without fishing permits, so fishing and fishing gear are not allowed on them.
- The captain may end a charter without a refund for unsafe, illegal or abusive behavior.
- Swimming, snorkeling and paddle activities happen only where and when the captain allows. You swim at your own risk and should tell the crew about any health condition that affects it.
- Guests pay for damage they cause to the yacht or its equipment beyond normal use.
- Children are welcome with a responsible adult who watches them at all times. Children wear a life jacket whenever the crew asks.
- Guests who are visibly intoxicated may be refused boarding for their own safety, without a refund.
9Food, drinks and extras
- You are welcome to bring your own food and drinks on any yacht.
- Food and drink orders are confirmed in writing with your charter. Tell us about allergies and dietary needs when you order.
- Breakfast is served on departures before 12 PM. Box lunches and the Mexican feast are available on every departure.
- Extras such as drone photos, decorations, flowers or music are arranged on request, confirmed in writing and quoted separately. Until we confirm them, they are not part of your booking.
- Menu photos on this site are illustrative. Dishes are prepared fresh and may look different.
10Routes and protected areas
- Routes on this site are typical, not guaranteed. The sea, the authorities and the time available decide the final route.
- Authorities sometimes close areas such as the beach under the Arch or Divorce Beach. A closed stop is skipped and is not grounds for a refund.
- Mexico protects its marine wildlife. The crew follows the whale-watching norm NOM-131-SEMARNAT-2010 and keeps its distance from sea lions and whales. Feeding or touching wildlife is not allowed on our charters.
11Risks and liability
- Being on the water carries risks that cannot be removed: seasickness, slips and falls on wet decks, falling overboard, sunburn and heat, cuts from rocks or coral, marine animals, injuries while swimming, snorkeling or using slides, mats and paddle boards, and in serious cases drowning or death. Alcohol makes every one of them more likely.
- You take part by your own choice and accept these risks for yourself and for the minors in your care.
- The operator of the yacht is responsible for navigation, for the captain and crew and for safety on board. Claims for injury, death or damage that happen during a charter are made to the operator and its insurer. We help you reach them.
- Our responsibility as a booking agency covers the booking itself: your confirmation, your payment and your access to the yacht. To the extent Mexican law allows, we are not responsible for injury, illness, death, loss or damage during a charter, or for the acts or omissions of operators, captains, crews, other guests or third parties.
- We are not responsible for what guests do. Each guest answers for their own behavior, for the minors in their care and for any harm they cause to themselves, to other people or to the yacht.
- We are not responsible for indirect losses such as a missed flight, a missed cruise ship departure, another tour or a hotel night.
- If we are found responsible for something, our liability is limited to the amount you paid us for that charter, to the extent Mexican law allows.
- Before boarding, the operator may ask every adult guest to sign a release form. Guests who do not sign it do not board, and that is not grounds for a refund.
- Tell the crew before departure about pregnancy, heart or back conditions, recent surgery, or anything else that affects your safety on the water. If you are not sure you should go, ask your doctor.
- We recommend travel insurance that covers medical care and water activities in Mexico.
- Keep your belongings with you. We are not responsible for personal items lost or damaged on board or in the water.
- Every yacht is checked in person before it is listed, with current navigation permits and passenger liability insurance on file.
- Nothing in these terms takes away rights that Mexican consumer law gives you and that cannot be waived.
12Photos
- The photos on each page are the yacht you board, not stock images.
- The crew may take photos during a charter for our website and social media. If you prefer not to appear, tell the crew before departure and we will not use any photo of you.
13Privacy
- We collect only what you send us to plan and run your charter: your name, dates, group size, occasion, food order and the phone number or email you write from.
- We use it to answer you, confirm the charter and coordinate with the captain and crew. We do not sell it. We share it only with the people who operate your charter, with payment processors, or when the law requires it.
- The planner saves your choices in your own browser so they are still there if you come back. Nothing is sent to us until you press send in WhatsApp, iMessage, SMS or email, and those messages travel under the privacy terms of those services.
- To process a payment, Stripe receives your name, email and card details directly on its own secure page. We only see that the payment went through, the amount and the email you used. Stripe's privacy policy applies to that data.
- Reference photos you add in the planner stay on your device. This site does not upload them; they reach us only when you share them yourself through WhatsApp, iMessage or another app.
- This site uses Google Analytics to count visits and see which pages are read. It sets cookies and sends Google anonymous data about your visit, such as pages viewed, device and approximate location. You can block it with your browser settings or Google's opt-out add-on (tools.google.com/dlpage/gaoptout). Its fonts load from Google Fonts, which receives your IP address. The forecast is requested by our server from MET Norway without any data about you.
- When you pay, we record the date and time, the IP address and the browser from which the terms were accepted, as proof of acceptance.
- After your charter we may send you a link to review it. We publish a review only if you agree to it: your rating and text, your name as you write it, your country if you add it, and the month and year of your charter. Your email, phone and booking details are never shown. We keep the date and time, the IP address and the browser of your consent (privacy notice version of October 9, 2026). To have your review removed, write to [email protected].
- That link reaches you in a single email, sent after your charter to the address you gave us when booking. We send no reminders. If you would rather not get it, write to [email protected] and we will not send it.
- Under Mexico's personal data protection law you can ask us to show, correct or delete your data, or to stop using it. Write to us and we will answer within the time the law sets.
14Governing law
- These terms are governed by the laws of Mexico. Any dispute is handled in the courts of Cabo San Lucas, Baja California Sur, without limiting your rights as a consumer under Mexican law, including your right to contact PROFECO.
- We may update these terms. The version that applies is the one published on the day you book.
